This privacy notice is provided to our customers from the European Economic Area and contains overview of our privacy policy regarding their personal data. This privacy notice provides all information required by the Regulation (EU) 2016/679 of the European Parliament and the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

 

FDC Servers.net LLC (“FDC”) acknowledges the importance of personal data protection and strictly complies with all an any applicable legal regulation, particularly GDPR. Protection of your privacy is a top priority for us and you can be sure that we make every effort to ensure to protect your rights and confidentiality of your personal data.

2. Did we designate a Data Protection Officer?

FDC is not obliged, in accordance with GDPR, to designate a Data Protection Officer. But we have designated our representative in EU who will deal with all issues relating to the processing of your personal data. 3. What purpose and title for processing of your personal data do we have

FDC processes your personal data for the following purposes:

Processing is necessary for the performance of a contract between you and FDC or in order to take steps prior to entering into such a contract at your request. FDC is authorized to process your personal data necessary to perform the TOS Agreement (see our Terms of Service). Your consent to the processing of such personal data is not necessary.


Processing is necessary for compliance with a legal obligation to which FDC is subject. Your personal data is further processed to the extent necessary to meet the legal obligations imposed on FDC. Such obligations include particularly accounting and record keeping.


Processing is necessary for the purposes of the legitimate interests pursued by FDC. FDC may process your personal data in justified cases in order to protect its rights and legitimate interests. Such legitimate interests include enforcement and protection of our rights, recovery of any debts owing to us, etc.

 

4. Categories of personal data concerned

To meet the purposes listed in Section 3 above FDC processes, to the extent necessary, the following categories of your personal data:

identification data;
contact details;
billing and payment information;
data on the services provided under the TOS Agreement;
data required for keeping your user account;
IP addresses, cookies.


5. Who are recipients of your personal data


Your personal data may be transferred or made available only to those entities that provide sufficient guarantees to protect your rights and privacy, in particular by introducing appropriate technical and organizational measures to ensure that the processing complies with statutory requirements and, in particular, GDPR requirements. 

In case we will use another processor to process your personal data, this processing will be governed by a written agreement concluded between us and this processor which will contain all required elements an accordance with GDPR.

 

Your personal data may be transferred to the following categories of recipients:
our help desk and customer service providers;
law enforcement agencies;
other state or governmental bodies entitled to receive your personal data in accordance with the applicable laws;

6. Transfers of your personal data to a third country or an international organisation


FDC has offices and facilities in the US. The European Commission has made an "adequacy decision" on the basis of Article 45 of GDPR and has recognised the US as providing adequate protection to personal data. Your personal data are not transferred to any other third country or to any international organization.

 

7. The period for which your personal data will be stored

Your personal data will be processed only for as long as any legal title to such processing is in place, as detailed in this document.

 

8. Automated decision-making process, including profiling

Processing of your personal data does not involve automated decision-making, including profiling.

 

9. Your rights under GDPR

GDPR guarantees you certain rights in order to protect your privacy. These rights include:

the right to restrict processing;
the right to object to processing;
the right to data portability;
the right to complain to a supervisory authority.
